Big Cat Training Limited is a registered company 04991983 and our registered office address is: 20 Cheriton House, Cromwell Park, Chipping Norton, Oxfordshire OX7 5SR.  Big Cat Training is a registered Data Controller (ICO Registration Number:  ZA777888).

Big Cat Training Limited owns the UK franchise for Sandler Training.    Big Cat Training Limited and Sandler Systems, Inc. whose office is at 300 Red Brook Boulevard, Suite 400, Owings Mills, Maryland, 21117, USA are the data controllers for personal data about clients, prospective clients, job applicants and our current and former employees, event attendees and newsletter subscribers.

“Personal data” is defined by the General Data Protection Regulation (EU Regulation 2016/679) (the “GDPR”) and the Data Protection Act 2018 (collectively, “the Data Protection Legislation”) as ‘any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier’.

Personal data means, in simpler terms, any information about you that enables you to be identified. Personal data covers obvious information such as your name and contact details, but it also covers less obvious information such as identification numbers, electronic location data, and other online identifiers.

  • To support you in becoming a Sandler UK Franchisee.
  • To answer enquiries that you make prior to any investment in the franchise.
  • To send you information about events or services that you may be interested in

  • To fulfil our obligations as an employer
  • To provide benefits to you as an employee
  • To maintain security of our office and IT infrastructure
  • To invoice you, and to track payments you make or payments made to you

We believe that all these purposes are justified on the basis of our legitimate interests in running and promoting the company, our contractual requirements to deliver agreed services to you and our legal obligations, both as a limited company and responsible employer. Franchisees

As a franchisee, we will hold the following information about you:

  • Name and contact information.
  • Company information
  • Demographic information such as postcode.
  • Experience and qualifications, via for example a CV
  • Information and documents relating to your franchise business, including communications with you, and contracts.
  • Billing and payment information.
  • DISC and Harver psychometric profiles where appropriate.

We use your Personal Data to meet our contractual requirements with you as one of our Franchisees.  We also use your Personal Data as required by law, such as for tax purposes.  We also use your information to invoice you, and to keep track of payments that you make.

We currently use third-party online tools:

  • Xero to manage your billing and payment details. Xero uses servers that are based in the US, therefore personal information is transferred outside of the UK and EEA.  For more information please view Xero’s privacy policy.  

 

  • Extended Disc to understand preferred communication style. Extended Disc uses servers that are based in the US therefore personal information is transferred outside of the UK and EEA.

 

  • Harver to produce strength and weakness reports. Harver uses servers that are based in the US, therefore personal information is transferred outside of the UK and EEA.

 

  • HubSpot to manage our communications with you, and to provide you with a Sales System to support your franchise’s operational, sales and marketing activities.  HubSpot use servers based in the US and other countries around the world, therefore personal information is transferred outside of the UK and EEA.  For more information, please view HubSpot’s Privacy Policy

 

We will retain information about you for the duration of our relationship with you, then 2 years.  We will retain financial records for 6 years, following the end of the current financial year.

Prospective Franchisees

As a prospective franchisee, we will hold the following information about you:

 

  • Name and contact information.
  • Demographic information such as postcode.
  • Communications with you about your interest in becoming a Sandler Franchisee, included relevant information and documents when they become necessary in the process.

We use your Personal Data to respond to an enquiry you have made about becoming a franchisee, whether this is in person, by email, via our own website, or via a Franchise Directory website.

We currently use third-party online tools:

  • HubSpot to maintain contact details and to manage our communications with you, particularly in relation to setting up an initial conversation in response to your enquiry. HubSpot use servers based in the US and other countries around the world, therefore personal information is transferred outside of the UK and EEA.  For more information, please view HubSpot’s Privacy Policy

We will retain information about you for the duration of your enquiry with us, then a maximum of a year after if you decide not to proceed with a Sandler Franchise.   If you become a Sandler Franchisee, please refer to the section above for further details on how we use your personal data.  You can also unsubscribe from the initial communications at any time if you wish.

Prospective Sandler Training Clients

If you make an enquiry about Sandler Training to us via email, phone or the contact us page on our website, we will use this information to assign you to the local Sandler Training Franchisee.  They will follow-up on your enquiry to see if they can help you.  At the end of the enquiry process they will either transfer your data to your own client file, add you to their marketing process (with your consent) or delete your information after one year.

We currently use third party online tools:

  • HubSpot to maintain contact details, project details and proposal details, and to manage our communications with you. We will retain information about you for the duration of the enquiry, then one year.  Please also consult the local Sandler Training Franchisee for their specific retention periods.

Event Attendees

When you book onto a Sandler workshop, talk or event (including online Zoom events), we ask you to provide us with your name, email address, contact telephone number and payment details (if necessary).   We process your details purely for the purpose of administering the event, and to send you a copy of the recording afterwards (where online events have been recorded).  Please note, only the speakers at an event are recorded, so your details will not be visible on the recording.

We currently use third-party online tools:

  • Eventbrite to manage your booking and payment details. Eventbrite uses servers that are based in the US, therefore personal information is transferred outside of the UK and For more information please view Eventbrite’s privacy policy.
  • Zoom to deliver webinars and online events. Zoom uses servers that are based in the US, therefore personal information is transferred outside of the UK and  For more information, please view Zoom’s privacy policy

We will retain information about your booking for  3 months, at which point we will delete your details.

Job Applicants

When you apply for a job with us, we may hold the following information about you:

  • Name and contact information.
  • Information relating to your qualifications and experience
  • Demographic information such as postcode, marital status, income levels
  • References where we take them up
  • Information and documents relating to the review, interview and selection process, including communications with you.
  • DISC and Harver psychometric profiles where appropriate.

We use your Personal Data to assess your suitability for available roles within our organisation and in preparation for entering into an employment contract with you.  We may also use your Personal Data to ensure we are complying with our legal obligations as a responsible employer, e.g. confirmation of identity.

  • Extended Disc to understand preferred communication style. Extended Disc uses servers that are based outside the US therefore personal information is transferred outside of the UK and EEA.

 

  • Harver to produce strength and weakness reports. Harver uses servers that are based in the US, therefore personal information is transferred outside of the UK and EEA.

 

We will retain your personal data relating to the review, interview and selection process for a period of 6 months after the interview date.

Current and Former Employees

When you work for us, we may hold the following information about you:

  • Name, date of birth, and contact information
  • National insurance number and Unique Tax Reference (UTR)
  • Information relating to your qualifications and experience
  • Demographic information such as postcode, marital status and income levels
  • Information and documents relating to your performance and supervision as an employee of the company, including communications with you
  • Your photograph, including Passport or Driving Licence
  • Financial information, such as bank details, pension scheme and salary details
  • Information about your next of kin
  • DISC and Harver psychometric profiles where appropriate.

We will use your personal data to manage all elements of the employment contract we have with you and to support your development within the business and We will also use your Personal Data to ensure we comply with our legal obligations as a responsible employer, e.g. payroll and tax purposes.

We currently use third-party online tools:

We will retain your personal data for the duration of your employment and for a period of 7 years after you leave the company.  We share your information with HMRC, and our chosen pension / benefits providers.

Who has access to your information?

Sandler Training UK Franchise

Big Cat Training Ltd owns the UK franchise for Sandler Training.  Sandler Training worked with HubSpot to provide a bespoke, effective Client Relationship Management System for the franchise.  Big Cat Training Ltd are responsible for managing the HubSpot CRM for the UK.  This means we will set up each franchisee to have access to HubSpot, where they can manage their own client and prospect data within a secure, closed environment (i.e. it is not used by or accessible to other franchisees).  As the overall administrator of Sandler Training UK’s HubSpot CRM, we need may to provide support to individual franchisees as they use the system and are responsible for maintaining overall integrity and quality of the data.  As such, we may see or access the data stored within a franchisee’s area in certain circumstances, e.g. providing support using the system, deduplication of individuals for data quality purposes, or to move clients to another location should a franchisee close their business.

Third-parties

We do not sell or rent your personal data or information to any third party or share your information with third parties for their marketing purposes.

We will disclose your data or information if required by law, for example by a court order or for the prevention of fraud or other crime.

We may pass your information on to third party service providers for the purposes of completing a task or providing services to you on our behalf. However, we disclose only the personal information necessary to deliver that service and have a contract in place that requires them to keep your information secure and not to use it for other purposes.

In addition to the third-party online tools listed above, we engage the following third-party service providers:

  • Thomson and Thomson Ltd to support us with our marketing communications, which means they will have access to your information. They cannot use your data for their own purposes.
  • Databasix UK to support us with data protection advice and guidance, which may mean that personal details are shared if specific advice is required. They cannot use your data for their own purposes.

Transfers outside of the UK and European Economic Area

We may store or transfer some or all of your personal data to countries outside of the UK and that are not part of the European Economic Area (the “EEA” consists of all EU member states, plus Norway, Iceland, and Liechtenstein). These are known as “third countries” and may not have data protection laws that are as strong as those in the UK and/or the EEA. This means that we will take additional steps in order to ensure that your personal data are treated just as safely and securely as they would be within the UK and under our Data Protection Legislation as follows:

  • We share your data with external third parties, as detailed in the table above, that are based outside of the UK & EEA. The following safeguards are applied to such transfers:
    • We will only transfer your personal data to third countries whose levels of data protection are deemed ‘adequate’ by the Information Commissioner’s Office.
    • We use specific contracts with external third parties that are approved by the Information Commissioner’s Office and European Commission for the transfer of personal data to third countries.     • Where we transfer your data to a third party based in the US additional steps have been taken to ensure your personal data will be treated as securely and safely as it would be in the UK and under the GDPR. We have signed Data Processing Agreements with our data processors based on model contract clauses provided by the Information Commissioner’s Office and European Commission (also known as ‘standard contract clauses’), which impose suitable data protection standards on a contractual basis.

Your Rights

You have certain rights over the processing of your personal information by Big Cat Training Ltd.  These are:

Keeping your data secure

When you give us personal information, we take steps to ensure that it’s treated securely and strive to protect it on our internal systems.  Our cloud storage solutions are appropriately protected and we ensure that only those people who have the right to access personal data are given the appropriate permissions to do so.

We use Transport Layer Security (TLS) to encrypt and protect email traffic in line with government standards. If your email service does not support TLS, you should be aware that any emails we send or receive may not be protected in transit.
